These Terms of Service ("Terms") govern your access to and use of the CreteGenie platform and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
CreteGenie provides software for concrete and construction contractors to create estimates and proposals, visualize finishes, schedule work, send invoices, accept payments, and manage customers. We may add, change, or remove features over time.
You are responsible for the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. Notify us promptly of any unauthorized use. You must be at least 18 years old and authorized to act on behalf of your business.
You retain ownership of the business and customer data you enter. You grant us the limited rights needed to host and process that data to operate the Service. Our handling of personal information is described in our Privacy Policy.
The Service may connect to third-party services you choose to enable (for example, QuickBooks Online, payment processors, and messaging providers). Your use of those services is subject to their terms, and we are not responsible for third-party services. When you connect QuickBooks, you authorize us to access only the company you select to provide the sync features you enable, and you may disconnect at any time.
Paid plans are billed in advance on a recurring basis (monthly or annually) as described at sign-up or in your account, and renew automatically until you cancel. You can cancel at any time from your own account, without contacting us: click your name, open Your account, and choose Cancel subscription. The same Cancel subscription link appears in Settings under “Your subscription”. Either one takes you straight to the cancellation screen in our payment provider’s secure portal. If you subscribed through PayPal, you can also cancel the recurring payment directly from your own PayPal account. You may also email us at support@cretegenie.com and we will cancel your subscription for you. When you cancel, your plan stays active through the end of the billing period you have already paid for, and you will not be charged again after that.
Except where required by law, fees already paid are non-refundable, and we do not provide automatic prorated refunds for partial months, partial years, or unused time after a cancellation. If you would like to request a refund — for example, if you were charged in error or are not satisfied — email us at support@cretegenie.com and we will review your request and, at our discretion, issue a refund where we agree it is fair. Any refund we issue applies to your most recent payment.
We may change pricing with reasonable advance notice; any change takes effect on your next billing cycle.
The Service lets you send messages — including emails and text messages (SMS) — and estimates, proposals, and invoices to your own customers and contacts. You are solely responsible for those communications and for having the necessary permission or consent to contact each recipient. You represent and warrant that your use of the Service's messaging features complies with all applicable laws, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and any other laws governing email and text messaging, and that you will honor opt-out and unsubscribe requests from your recipients. CreteGenie provides the tools but does not review, control, or take responsibility for the messages you choose to send.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free. The Service is a tool to assist your business; you are responsible for your own pricing, estimates, contracts, tax treatment, and compliance.
To the maximum extent permitted by law, CreteGenie will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the twelve months before the claim.
You agree to indemnify, defend, and hold harmless CreteGenie and its owners, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) the data or content you enter, upload, store, or send through the Service; (c) your communications with your own customers or other recipients; (d) your violation of these Terms or of any applicable law; or (e) your infringement of any third party's rights. We may, at our option, assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.
You may stop using the Service at any time. We may suspend access for non-payment, and we may suspend or terminate access if you violate these Terms or to protect the Service. After your account is canceled or terminated, we may delete your data after a reasonable period, so you should export any data you wish to keep before you cancel. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
